We know you can’t wait to receive your item and we aim to ship your order as fast as possible. Our average delivery lead time from the day you have placed your order is:

2-3 days for Metro Manila
3-5 days for provincial towns

Occasionally shipments through our external logistics partners are delayed by factors outside of our control. If you are still waiting for your parcel beyond our usual lead time (2-3 days in Metro Manila, 3-5 days in provincial towns, 5-7 days in rural areas), please contact our customer service and we will follow up on your shipment.

DELIVERY

WHEN CAN I EXPECT DELIVERY OF MY ORDER?

If you place your order before 8am, it usually gets shipped from our warehouse the next day. We hand it over to one of our logistics partners and you will get a shipping confirmation email indicating the estimated delivery day. For Metro Manila most orders are delivered within 2-3 days. You can expect delivery of your order within 3-5 days in provincial towns or after 5-7 days if you live in a rural area. Please, be advised that there are no deliveries on weekends.

CAN YOU DELIVER TO MY OFFICE ADDRESS?

Yes, of course! Your parcel can be delivered to an office address. Please enter the address along with your full name upon checkout.

If you would like the package to be dropped off at the office reception, please leave us a note in the “Order Notes” field of the checkout page and leave a letter of authorization with the recipient.

If you’ve just finished placing your order, please email us at [email protected] and we’ll try to modify your order. If more than 24 hours have passed, chances are good that we have already packed and shipped your order! In either case, please email us at [email protected]

WHAT FORMS OF PAYMENT DO YOU ACCEPT?

WHAT IS CASH ON DELIVERY (COD)?

  • Cash on Delivery is a safe and risk-free payment method and you only pay upon receiving your goods. Choosing that payment method also allows your order to be processed faster.
  • Please note that for security purposes you need to pay the Cash On Delivery amount before opening your parcel and trying on your items.

WHAT IS PAYPAL?

  • PayPal is a payment method for online purchases enabling buyers and businesses to send and receive money online. As of today, PayPal has over 100 million member accounts in 190 countries and regions. One advantage of using the PayPal payment method is that it offers faster, safer and easier checkouts and promises to protect customers from revealing their credit card and other financial information to the merchant.

RETURN POLICY

Items in good condition

  • For items in good condition, you have 7 calendar days to return it from the date you received it.
  • Our criteria for this is simple. And it was made with you in mind. How? We define items in good condition as items still perfectly re-sellable to another discerning customer like you. That means unused, unaltered, unopened and still sealed with all original parts and components intact.
  • If your answer is yes to all of the above and it’s been 7 calendar days or less since you received your item, you should have no problems with your return.

Items NOT in good condition

  • For items that you discover to be defective or damaged after receiving them, you have only 3 calendar days to return.
  • Your items will be sent to our office. These shall be examined further by our team.
  • Our team reserves the right to make the final call. And they certainly reserve the right to dispute claims that items were received in a NOT good condition.
  • If after careful inspection, the items did not meet their standards: no refunds shall be processed. We will simply send them back to you, which should take an additional 3 business days.

How do I return an item?

If you’re a hundred percent sure you want to return, please drop off your item at office. Here are our drop off points for returns:

If you want your return to go smooth (and we’re sure you do), make sure you do the following:

  1. Bring two (2) things:
    a. Delivery Receipt
    b. Item for return
  2. Make your way to our office. Or send someone in your behalf.
  3. Heads up: Just because we received your item doesn’t automatically mean you’ll be refunded.
  4. Leave your items with us. These shall be examined further by our team.
  5. Our team will make the final call: your items are either OK for return or not.
  6. After they’ve reached a decision, we will send you an email.
  7. What to expect:
    a. If your items have been deemed as being in good condition and is OK for return, we will refund your item within 3 business days.
    b. On the other hand, if after careful inspection, the items did not meet our team’s standards, no refunds shall be processed. We will simply send them back to you, which should take an additional 3 business days.

Athalia Marie. (“Athaliamarie”, “we”, “us”, “our”) respects the privacy of our Users (“you”, “your”, “yours”, “Users”). Please read on to learn what information we collect from you and how we use that information. By using or accessing www.athaliamarie.com.ph (the “Service”), you acknowledge that you have read, understood and agree to be bound by all the terms of this Privacy Policy.

What information does Athalia Marie collect?

We collect various types of personal information from our Users. Personal information refers to information by which you can be identified. We may use this information to, among other things, personalize and improve our services, allow our users to register as a member, contact Users, fulfill your order requests for products, analyze how Users use the Service, or as otherwise indicated in this Privacy policy. We may share certain types of Personal Information with third parties. We collect the following types of information:

A. Personal Information

  • We receive and store any information you knowingly provide us. We collect Personal Information such as your name, username, email address, mobile phone number, shipping address. We may also collect your shopping behavior and preferences, and maintain a record of the purchases and transactions you make on our web site.

B. Non-Personal Information

  • Non-Personal Information is defined as information that does not identify a specific User. As is true for most web sites, we automatically receive and record information on our server log files from your browser including your Internet Protocol (IP) address, browser type, Internet Service Provider (ISP), URLs that refer visitors to the web site, operating system, general geographic location, date and time stamp and cookie information.
  • A “cookie” is a small text file stored on a User’s computer or other Internet-connected device which contains information about the User. We use cookies to save you time while browsing and shopping on Athalia Marie and help us better understand shopping behavior, with the purpose of providing a customized shopping experience. Cookies also tell us which pages in our web site people have visited and by how many people. We also collect information by use of “web beacons,” also known as an Internet tag, pixel tag or clear GIF, to track your use of our web site pages and promotions, or we may allow third party service providers to use these on our behalf. Will Athalia Marie share information it collects?

We will not rent, sell nor disclose your Personal Information with other parties except only as described below:

A. We may share your information with Athalia Marie Suppliers

  • Some circumstances call for us to share some of your Personal Information with Athalia Marie merchants. For example, we may share with Gear Up Suppliers information to fulfill your orders as well as aid in post-purchase requests like responding to your questions and comments and facilitating returns and exchanges. This means that a Gear Up supplier may communicate with you directly should they choose to do so. We specifically disclaim any responsibility or liability for the actions of such Gear Up supplier.

B. We may share your information with Third Party Service Providers

  • We employ other companies as authorized third party providers to perform a function or provide services for you on our behalf. For example, a third party service provider may send out or distribute transactional and promotional emails. We may also share Personal Information to third party service providers to fulfill orders, deliver packages, send postal mail or electronic mail, administer contests or sweepstakes, remove repetitive information on customer lists, analyze data, provide marketing assistance, provide search results and links, process credit card payments, operate the Website, troubleshot and provide customer service. We will only share your Personal Information to the extent that we deem it necessary or related to such transaction or service. The use of Personal Information by such parties is governed by their privacy policies and is not subject to our control.

C. We may remarket your information

  • Remarketing is a way for us to reconnect with our Users. Third-party marketing vendors may be enlisted by Athalia Marie to provide remarketing services, and may display ads of Gear Up on sites across the Internet. Third-party marketing vendors use cookies to serve ads based on your past visits to Gear Up’s web site.

D. We may share information in a business transfer

  • We may transfer Personal Information about our Users in the event we sell, merge or transfer all or a portion of our business or assets. Personal Information would remain subject to this Privacy Policy.

E. We may share your information for our protection and protection of others

  • We reserve the right to release Personal Information about you if we are required to do so by law; in compliance with a judicial proceeding, court order or legal process; to enforce or apply this Privacy Policy, our Website Terms and Conditions or other agreements; or if we deem it necessary to protect the rights, property or safety of Athalia Marie, our employees, our Users, or others. We may disclose information to companies and organizations for fraud protection.

Is Personal Information About Me Secure?

Gear Up takes extra measures to protect the security of your Personal Information. You can access your Personal Information on our web site through your account, which is protected by a password. This password is encrypted. To keep your Personal Information secure, we recommend that you do not share your password with any individual. If you registered for an account via Facebook, you may have additional or different sign-in protections through Facebook.

We strive to protect the privacy of our Users and their Personal Information, but no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. We cannot guarantee the complete security of information transmitted to or from our web site, and are not responsible for the actions of third parties that may receive such information.

We’re glad you’re here. Thank you for accessing and using our online service and web site (collectively the “Service”). The following terms and conditions (the “Agreement”) constitute an agreement between Athalia Marie (“Athalia Marie”, “we”, “us” or “our”) and you (“you”, “your” or “User”).

By using our Service, you acknowledge that you have read, understood and agree to be bound by the Agreement. Please read them carefully. If you do not agree with the Agreement, please do not access or use the Service.

General

  • The Service provides a marketing platform in the World Wide Web of the Internet where third party merchants or retailers (“Merchants”) can offer products (“Products”) to and transact with the Users of the Service, wherein Athalia Marie facilitates payments in behalf of the Merchants and provides all relevant services required to fulfill the order requests of Users.

Modified Terms

  • We may modify the terms and conditions from time to time, as we deem necessary. Please check back periodically to review the changes.
  • Your continued use of the Service following such modifications shall signify your acceptance of the modified Agreement. If you do not agree with the modified Agreement, you may not access or use the Service.

Eligibility

  • The access and use of the Service by any minor under the age of 13 is prohibited. The Service is not available to Users suspended or removed from the system by Athalia Marie.

Membership

  • To gain access and use some portions and features of the Service, you will need to register as a member. Registering as a member requires you to expressly signify your acceptance of the Agreement.
  • You are required to provide information about yourself that is true, accurate, current and complete. If you furnish information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete) or if Athalia Marie suspects that such information is untrue, inaccurate, not current or incomplete), Athalia Marie reserves the right to suspend or terminate your membership.
  • You are responsible for maintaing the confidentiality of your account and password, and for restricting access to your account. You are solely responsible for all activities that occur under your account. You agree to notify Athalia Marie immediately of any unauthorized use of your account or breach of security.
  • You shall not use your Athalia Marie membership for any purpose competitive to Athalia Marie.
  • Unless you cancel your order, acceptance of your order will be perfected upon completion of the packing of your order. Completion of the contract between you and Athalia Marie will be perfected when we dispatch the goods to you at which time you will receive a second email containing your tracking number, and confirming that your order has been dispatched.
  • Athalia Marie reserves the right not to accept your order in the event that we are unable to obtain authorization for payment, shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards.
  • Further, we may refuse to process an order at any time for any reason at our sole discretion.

Pricing

  • All prices posted on the web site are inclusive of government-imposed taxes. Athalia Marie tries to advertise the most accurate and up-to-date pricing information on the products offered on the web site. We cannot, however, warrant against pricing error. If you have placed an order for a product whose price was posted incorrectly, we will either not process or cancel your order. Should this happen, we will notify you via email.

Shopping

  • Each item in your shop cart is reserved for thirty (30) minutes. After thirty (30) minutes has elapsed, the item is released back into the pool of available inventory and may be purchased by other customers.
  • Once your order has been placed, you will receive an Order Acknowledgement email. Your receipt of an Order Acknowledgement email does not mean Athalia Marie’s acceptance of your order. We are simply acknowledging that we have received your order.
  • Athalia Marie may, in its sole discretion, choose to accept or decline your order for any reason. This may happen, for example, when the item you wish to purchase is out of stock or has been damaged; we suspect the request is fraudulent or in any other circumstance Athalia Marie deems appropriate. For orders that were not processed or canceled, Athalia Marie will either not charge you, or refund you the total billed amount.
  • We are quite confident that you’ll be delighted with the products you order at Athalia Marie. If the product does not meet your expectations, you may return it, provided it is in good condition, within 7 calendar days of your receiving the product. For a damaged product, you have 3 calendar days to return.
  • You may cancel your order provided your package has not yet been shipped. Please take note that the processing & delivery fee of P150 is non-refundable.
  • Athalia Marie takes extra measures to provide you with accurate information on products we offer on the web site. Athalia Marie does not guarantee, however, that the information is accurate, error-free, current, complete or reliable.
  • Inventory levels fluctuate from day-to-day. In rare cases, you may have been able to place an order online for a product portrayed as having stock, but once we attempt to process find out that the product is sold out. In cases like these, we will notify you via email.
  • We try to display the colors of products as accurately as possible on the web site. We cannot guarantee, however, that your computer monitor’s display of colors will be true to life.

Intellectual Property Rights

  • The Service and every material and proprietary information therein, including but without limitation to, software, designs, images, photographs, text, graphics, illustrations, logos, patents, copyrights, trademarks, service marks, audio, video, music and all other intellectual property rights related thereto, including all code in the web site (collectively “Athalia Marie Content”), is the exclusive property of Athalia Marie or used with express permission of the copyright and trademark owners.
  • Use of Athalia Marie Content for any purpose not expressly permitted by this Agreement is strictly prohibited. You agree not to reproduce, distribute, sell, license, rent, modify, transmit, publish, adapt, edit or create derivative works from Athalia Marie Content and all materials accessible on the Service. Violation of this policy may result in civil and/or criminal penalties.

Service Rules

  • You agree not to use any “deep-link,” “page-scrape,” “robots,” “spiders,” “offline readers,” or any other automated system, program, algorithm or methodology, or any similar or equivalent manual process, to access the Service in a manner that sends more request messages to Athalia Marie servers than a human can reasonably produce in the same period of time by using a conventional on-line web browser.
  • You agree not to probe, scan or test the vulnerability of the web site or any network connected to the site, nor breach the security or authentication measures on the web site or any network connected to the web site.
  • You agree not to attempt to interfere with, compromise the system integrity or security or decipher any transmissions to or from the Athalia Marie servers.
  • You agree not to engage in decompiling, reverse engineering, or otherwise attempting to obtain the source code of the Service.
  • You agree not to take action that imposes an unreasonable or disproportionately large load on our infrastructure.

Disclaimer of Warranty

  • The Service, Athalia Marie Content, and any product you purchase through the Service are delivered on an “as-is,” “as available,” and “with all faults” basis.
  • To the fullest extent permitted by applicable law, we disclaim any and all warranties of any kind, whether express or implied, including but not limited to, implied warranties of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement.
  • Athalia Marie does not warrant the Service will be uninterrupted, secure or error-free, that any defects will be corrected, or that the Service or the servers that make the site available will always be free of viruses or other harmful components.

Limitation of Liability

  • You agree that in no event shall Athalia Marie, its affiliates, officers, directors, employees, agents, suppliers be liable to you for any direct, indirect, special, consequential, economic, exemplary, incidental, or punitive damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or directly or indirectly related to:
    – The Agreement
    – The Service, including the Athalia Marie web site and any other web site or resource you access through a link from the Athalia Marie web site
    – The products made available or purchased through the Service, including any damages or injury arising from any use of such products
    – The use of or inability to use the Service or any other information access through the Service
    – or performance of any third party products or services
    – The legality, accuracy, reliability, quality or authenticity of Athalia Marie Content, advertisements, services or products provided by any party through the Site
  • Under no circumstances shall Athalia Marie be responsible for any damage, loss or injury resulting from hacking, tampering or other unauthorized access or use of the Service or your accounts.
  • Athalia Marie’s liability to you for direct damages for any claim related to any of the foregoing shall in no event exceed the amount which you have paid to Athalia Marie in conjunction with the product under which such claim first arose.

Indemnity

  • You agree to defend, indemnify and hold harmless Athalia Marie, its affiliates, officers, directors, employees, agents, suppliers, from and against any and all fines, penalties, claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys’ and experts’ fees) arising out of (1) your use and access of the Service (2) any product you purchase from the Service (3) your violation of any term in this Agreement (4) your violation of any third-party right, including without limitation any right of privacy or intellectual property right (5) fraud you commit, or your intentional misconduct or gross negligence.

Dispute Settlement

  • Any dispute arising from or relating to the Agreement, including any question regarding its existence, validity of termination, shall finally be settled by arbitration in Makati City, Philippines using the English language. Any arbitration award shall be final and binding upon the parties, shall be the exclusive remedy between the parties and may be enforced by judgment of a competent court having jurisdiction.

Electronic Communication

  • When you use or access the Service or send emails to Athalia Marie, you are communicating with Athalia Marie electronically. You consent to receive electronically any communications related to your use of the Service. Athalia Marie will communicate with you by email or by providing notifications on the web site. You agree that all agreements, notices, disclosures and other communications that are provided to you electronically satisfy any legal requirement that such communications be in writing. All notices from Athalia Marie intended for receipt by a customer shall be deemed delivered and effective when sent to the email address you provide on Athalia Marie.

Entire Agreement and Severibility

  • This Agreement shall constitute the entire agreement between you and Athalia Marie concerning the Service. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.
